If your workplace is unionized and your position is covered by a collective bargaining agreement, you should have the right to file a grievance if you have issues in the workplace regarding discipline, promotion, suspension or termination. Florida is an Open Shop state, meaning that even if your workplace is unionized, you do not have to be a member of the union for the Collective Bargaining Agreement to control the terms and conditions of your employment. If your position is unionized and you are not a member of the union, it may be difficult to get the union to represent you if you have a grievance. Unfortunately there are some union members who have concerns that the union officials and attorneys do not represent them to the best of their ability. Having had decades of involvement with unions and their practices, workers have good cause to seek their own attorneys to represent them in dealing with grievances, union and management.
