The Americans with Disabilities Act was amended as of January 1, 2009 to bring back protections lost in narrow U.S. Supreme Court decisions. The Amendments have rolled back the clock and protection is now based on broad interpretations of the Rehabilitation Act. Major life activities “include, but are not limited to, caring for oneself, performing manual tasks, seeing, hearing, eating, sleeping, walking, standing, lifting, bending, speaking, breathing, learning, reading, concentrating, thinking, communicating, and working.”
“Major life activities” also include “the operation of a major bodily function, including but not limited to, functions of the immune system, normal cell growth, digestive, bowel, bladder, neurological, brain, respiratory, circulatory, endocrine, and reproductive functions.”
“Both the list of major life activities and major bodily functions are illustrative and non-exhaustive, and the absence of a particular life activity or bodily function from the list does not create a negative implication as to whether such activity or function constitutes a ‘major life activity’ under the statute.” Managers Statement, 154 Cong.
