Practice Areas

Administrative-Hearings
There are many types of administrative hearings in which administrative judges make determinations on your employment, termination, discipline, promotion or other grievances and claims.
ADR
Alternative Dispute Resolution programs are being used by many corporations to usurp your civil rights.
Age-Discrimination
It is illegal to discrimination because of age in employment. Refusal to hire, promote, or otherwise treat employees differently in the workplace because of age violates the Age Discrimination in Employment Act (ADEA) if you can prove that your age was a motivating factor in the decision.
Arbitration
Arbitration is taking your case to a one person judge or three person panel to resolve your disputes rather than taking them to court.
Civil-Practice
Ft. Lauderdale Attorney Randy Fleischer has a civil practice that focuses on employment law.
Civil-Rights-Litigation
If your civil rights have been violated, either by discrimination in employment, housing or public accommodations, or if you have been the victim of police misconduct, you need an advocate who is not afraid to fight for your rights.
Discrimination-Actions
It is a violation of federal and state law to discriminate in employment, housing and public accommodations because of race, religion, national origin, gender or disability.
Disability-Discrimination
The Americans with Disabilities Act was amended as of January 1, 2009 to bring back protections lost in narrow U.S. Supreme Court decisions.
Educational-Issues
If you have problems involving the Broward County School Board, the Miami Dade School Board, the West Palm Beach School Board or any similar entity in the state, including colleges and universities, Ft. Lauderdale Attorney Randy Fleischer may be able to help you.
EEOC-Complaints
Filing a charge with the Equal Employment Opportunity Commission can be difficult
Employment-Contracts
Most people are "Employees At-Will" without an employment contract. If you have an employment contract or are negotiating or litigating one you need an attorney to advise you on your legal options or negotiate better terms.
Employment-Discrimination
Discrimination in employment is prohibited by many federal, state and local laws. Federal laws include Title VII, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Family and Medical Leave Act, and The Uniformed Services Employment and Reemployment Rights Act (USERRA 38 U.S.C. 4301-4333). These laws outlaw discrimination based on race, religion, national origin, gender, pregnancy, sexual harassment, disability, age, use of medical leave and because of military service.
Family-and-Medical-Leave
Family and Medical Leave (FMLA) – Federal law allows you up to 12 weeks of unpaid medical leave per year, after you have worked for an employer with 50 or more employees, for a year (at least 1250 hours) and need time to take care of a serious health condition of your own or that of an immediate family member.
Gender-Discrimination
Discrimination based on sex and sexual harassment continues to be a problem in the workplace.
Labor-And-Employment
Generally, when a reference is made to labor we are talking about a union shop. Florida is an Open Shop state, meaning that even if your workplace is unionized, you do not have to be a member of the union for the Collective Bargaining Agreement to control the terms and conditions of your employment.
Mediation
Whether you are mediating before a Federal Mediator, an EEOC mediator or other informal mediation/fact finding, you need an attorney to counsel you on what remedies are available.
Police-Misconduct
If you have been seriously injured or wrongfully incarcerated for an unreasonable length of time because of police misconduct or excessive force you need an attorney who is not afraid to stand up to authority.
Pregnancy-Discrimination
Terminating a woman when she is pregnant is often the most heinous type of discrimination.
Public-Records-Requests
If you need records from a state or federal public agency, Mr Fleischer is experienced in requesting those records
Non-compete-Agreements
Florida statutes provide for the enforcement of non-compete agreements against the employee who signs one and against employers who hire persons breaching a non-compete agreement.
Race-and-Racial-Discrimination
Despite the incredible strides that have been made, racial discrimination continues to exist. There remain people in society who believe they can tell the content of a persons character by the color of their skin.
Religious-Discrimination
Religious Discrimination has become more prevalent after 9/11 and understanding . Increased suspicions against people of the Islamic faith has caused friction in the workplace and in society in general.
Returning-Military-USERRA-Laws
When those who have served our country in the military return from duty they have a right to return their former employment without loss of benefits or responsibility
Settlement-Negotiations
A letter or phone call from an attorney can lead to a quick settlement that you might not be able to accomplish without a lawyer.
Severance-Agreements
If your employer has presented you with a severance agreement, it has to satisfy the requirements of The Older Workers Benefit Protection Act.
Sexual-Harassment
If you have been a victim of unwanted sexual harassment in the workplace and you want it to stop, or are seeking a remedy because you were fired after complaining sexual harassment, you need an attorney to fight for your rights.
Student-Rights
If you are a student facing discipline, suspension or expulsion, there are rights that you have to an education and to due process.
Unemployment-Compensation
If you have recently been separated from employment, you may have questions about your eligibility for unemployment compensation benefits.
Unemployment-Hearings
If you have applied for unemployment compensation benefits and the employer is contesting your eligibility, you will have a better chance at prevailing in the hearing if you have an attorney representing you with experience in such hearings.
Union-Grievance
If your workplace is unionized and your position is covered by a collective bargaining agreement, you should have the right to file a grievance if you have issues in the workplace regarding discipline, promotion, suspension or termination.
Whistleblower
Florida has statutes which protect both public and private employees from retaliation for blowing the whistle on illegal activities.
Workplace-Discrimination
Discrimination in the workplace is prohibited by many federal, state and local laws.
Wrongful-Termination
In Florida, there is no such thing as Wrongful Termination as a stand alone cause of action. Florida is an “at-will” employment state. That means you can be fired at any time, for any reason, without warning.
